Broadcasters want ownership rules overturned (Reuters)

LOS ANGELES (TheWrap.com) ? Broadcasters are urging the Supreme Court to loosen restrictions that prevent companies from owning newspapers, radio stations and television stations in the same market.

In a petition filed Monday, the National Association of Broadcasters (NAB) argues that the court must overturn a Third Circuit decision from last July that left most of the Federal Communications Commission's media ownership regulations intact.

The NAB argues that rather than resulting in dangerous monopolies, allowing broadcasters to own multiple news organizations helps them improve their financial health. That in turn gives them the flexibility to invest in higher quality reporting.

"By harming local television stations all over the country, the duopoly rule also directly harms the public," the petition reads. "When a station struggles financially or ceases to operate, it loses its ability to provide the news and public affairs programming on which members of the public rely. But placing stations under common ownership, resulting in an improvement in financial stability, leads to improved local programming -- both in quality and in quantity -- of the kind that is critical to viewers."

Furthermore, the petition says the Third Circuit's decision conflicts with lower court opinions related to broadcast media ownership rules, and asks the court to intervene so it can clarify the regulations.

The court didn't make its judgment on the merits of the case but said the FCC didn't follow the proper procedure when it changed its rules. Before it can change its rules, the FCC is required to seek public input; the court said the FCC didn't properly get that input.

Previously, a D.C. Circuit Court found that the rules were unnecessary.

The NAB petition argues that the Third Circuit was adjudicating based on an outdated conception of local media. It points out that broadcasters and newspapers compete for audiences and advertising with cable companies, satellite companies and internet sites, not just each other.

"Instead of counting only broadcast television stations, the Commission should have considered all outlets that compete for advertising and audiences in local markets," the petition reads.

The move comes as the FCC appears to be in favor of dialing back at least some of the rules.

FCC Chairman Julius Genachowski is reportedly in favor of loosening ownership rules in top media markets. However, some regulations would remain in place. For example, the commission would continue to limit the number of channels a company could control in local markets and would keep some bans on newspapers and television station cross ownership in place.

THOUSAND OAKS, Calif. (AP) ? Tiger Woods lost his three-shot margin with every shot that looked good until the wind decided otherwise. He lost his lead Saturday in the Chevron World Challenge because of something that was really out of his control.

Zach Johnson was 163 yards away in the 18th fairway, one shot behind and hopeful of getting his 7-iron onto the top shelf to make par as easy as possible. Imagine his surprise when it landed near the hole and hopped back into the cup for an eagle that put him atop the leaderboard.

"I would have been happy with a 4, let alone a 3," Johnson said. "A 2 is a steal."

That eagle gave him a 4-under 68, allowing him to make up a four-shot deficit on Woods and take a one-shot lead into the final round of the final official event this year in America.

Woods had three bogeys on the par 5s and didn't feel as though he did much wrong. On two of them, he hit wedges that looked good until the cool, gusting wind shifted directions and sent the ball much farther than he imagined. On the other par 5, his fairway metal hit a gust and dropped into a hazard.

The result was a 1-over 73. The prognosis wasn't nearly as bad.

"Even though I made three bogeys on par 5s, I had two three-putts, but I played well," Woods said. "I hit a lot of good shots that ended up in bad spots because I had bad gusts. So be it. That's the way it goes.

"I'm right there with a chance going into tomorrow."

Johnson was at 8-under 208 and will be in the final group with Woods, one shot behind. K.J. Choi overcame a double bogey on the par-5 second hole for a 72 and was three shots out of the lead. No one else was closer than five.

Woods had the 36-hole lead for the second straight tournament, and for the second straight time failed to break par in the third round. He felt differently Saturday than he did at the Australian Open in Sydney, where he opened with three straight bogeys and finished the day six shots out of the lead.

"Most of the time today, it wasn't me," Woods said. "I hit a lot of good shots today."

The wind was strong and chilly from the start, and rarely stayed the same direction very long. With a wedge in his hand, Woods went some 40 feet long on the second hole that led to a three-putt bogey. Another wedge on the par-5 13th sailed over the green and left a pitch he had no chance to get close.

Both players ran into trouble on the par-5 16th.

Johnson was playing in the group ahead of Woods, felt the breeze in his face and tried to hammer a driver that went left of the grass and into the gallery. He tried to clear a creek and went into the trees to the right before pitching out and taking a bogey.

Woods was in the fairway, but says a gust took his fairway metal too far right and into a hazard. He thought about trying to hit out behind a pair of rocks before choosing to take a penalty drop, and he also made bogey.

The difference was how they finished.

Johnson three-putted the 17th for another bogey, then drilled his 7-iron at the flag on the 18th for the most unlikely finish to his round. Woods had to settle for pars.

Johnson didn't realize his eagle on the final hole was for the lead. And even though he has a one-shot advantage, he doesn't think he's in contention until the final hour of any tournament.

Being in the last group with Woods, who has gone 26 starts since his last win?

"He's never going to shock me on the golf course because he's certainly the best player I've ever played with," Johnson said. "I'm glad I'm playing this week and I have the opportunity to go into Sunday with at least a chance."

Johnson, a former Masters champion, saw his streak end this year of four straight seasons winning on the PGA Tour. The Chevron World Challenge counts toward the world ranking, but is not official for the tour. He still wouldn't mind using it as a springboard for the next season, much like Tom Lehman did in the early days of this event, and Jim Furyk did in 2009.

For Woods, going from a three-shot lead to a one-shot deficit was not the end of the world.

He felt as though he played as well as he had the first two days, without having much luck with the wind. And for a guy who has gone two years without winning, the hardest part of hoisting a trophy is getting a chance.

Woods still had his three-shot lead when he chipped in from behind the fourth green for birdie. The wind was at its worst on the sixth hole, gusting hard with leaves scattered about the fairway. Woods felt it at his back and to the right, yet as the ball was in the air, it came against him from the left. He came up well short, chipped 7 feet by the hole and lipped out.

Hunter Mahan was the first player to make a run at Woods, going out in 33 and tying for the lead briefly after Woods had a three-putt bogey on the par-3 eighth.

Woods seemed to steady himself with a beautiful flop shot on the 10th that ran up the bank and trickled back 4 feet from the cup, and a solid approach to 18 feet for a two-putt birdie on the 11th.

But he went long of the 13th, turning a birdie hole into a bogey. He made a mess of the 16th with his penalty shot. And he had nothing to match an eagle from the fairway by Johnson on the final hole.

Economy imperils wildlife rescue

LOS ANGELES -- The disabled grizzly bears Huck, Jake, Pete and Mike arrived after a drive-thru animal park closed in 1985.

Drifter the tiger came as a cub after being seized in a 1997 Chicago drug raid.

Booie, the smoking chimp, was brought here in 1995 at age 28 when he was no longer needed for testing vaccines at the New York University School of Medicine.

Through the years, 76,000 animals have come and gone ? all welcomed by Martine Colette, founder and director of the Wildlife WayStation, one of the first animal sanctuaries in the country and, at one time, the largest.

Some of Hollywood's biggest stars have rallied around the WayStation in the past decade. Still, the fate of its remaining 420 animals is endangered by a drop in donations, rising upkeep and food costs, and the inability to pay staff.

"If the WayStation does not find a way out from under the horrific financial burden it is currently facing, caused by the current recession and disastrous economic downfall, then all these animals that came to us for safe haven are in real jeopardy," Colette said last week.

It's a problem that extends well beyond the cages and enclosures on her property 30 miles north of downtown Los Angeles. Times are hard for all nonprofits, especially donation-driven sanctuaries, said Adam Roberts, executive vice president of Born Free USA, a California-based animal welfare and wildlife conservation organization.

In recent months, the Wild Animal Orphanage in San Antonio closed because of overcrowding and lack of money. A Florida man lived in a cage with two lions for a month to raise money for his rescue center.

In Ohio, a man released dozens of lions, tigers and other animals from a private preserve before killing himself. Sheriff's deputies had to track and kill nearly 50 runaway animals. Authorities aren't sure of his motive, but he and his wife owed at least $68,000 in unpaid taxes.

Colette, 69, seems like an unlikely rescuer.

Born in Paris, she traveled with her Belgian diplomat father when he went on safari. Friends, colleagues and customers of her Hollywood costume and design business knew she had been to Africa and Asia, and they were always bringing her unwanted or unsuitable animals.

"They'd say, 'This ocelot is trying to eat our Chihuahua."

She took in her first animal in 1966 and a decade later found herself living with 50 animals in a three-bedroom house. Something had to give, so she sold her business, bought 162 acres in Tujunga Canyon in the Angeles National Forest and incorporated the Wildlife WayStation in 1976.

It was meant to be a place to treat and rehabilitate injured animals before returning them to the wild. But you can't release lions and tigers in this country and some animals were too sick to ever go back ? an eagle blind in one eye, the crippled grizzlies and the lab chimps.

She did not believe any animal in need should be turned away, no matter the problem, no matter the cost. It didn't matter if an animal was wild, tame, hurt or handicapped. Whether it was a hummingbird in a matchbox or 27 lions and tigers from an illegal game farm in Idaho, she embraced them all.

"When pot-bellied pigs were in demand, we had 146 come in at one time. There were a lot of ostriches when they were billed as the next white meat," she said.

For 35 years, Colette has had her hand out, gathering donations for her ever-changing stable of creatures. Hollywood has often rallied to her cause.

Betty White has been a supporter from the beginning. In 2001, Hollywood elite, including Brad Pitt, Bruce Willis, Russell Crowe, and Johnny Depp put together a CD called "Hollywood Goes Wild" to try and raise money for the WayStation. Sharon Stone made a YouTube plea for donations in 2009.

Colette's plea has never been as urgent as last week's.

She's had to lay off about a third of her staff, which has ranged from 42 to 50 people, and she wonders how she'll cover the $142,000 it costs a month to feed and care for the animals.

Problems extend to complying with environmental and permit regulations.

A decade ago, the WayStation had more than 1,100 permanent residents and 5,000 animals dropping in each year. But state officials banned public tours and barred the refuge from accepting new animals after waste was found in a stream and chimpanzees had contagious diseases.

A few years later, Los Angeles County refused to reissue its permit until roads were repaved, sewers replaced and electrical wiring upgraded.

The sanctuary acknowledged the environmental violations and started working on the expensive upgrades, tapping out its emergency fund.

Colette, who had hoped to retire, is open to a merger or partnership that would make money without exploiting the animals.

Someone suggested a wedding chapel on the picturesque grounds. Colette mused about a mountaintop restaurant.

"Everybody talks about how fabulous it is to come out here and listen to the lions roaring and the chimpanzees and tigers calling."

Russia vote watchdog head detained before election (Reuters)

MOSCOW (Reuters) ? The head of an independent Russian election watchdog was detained for 12 hours at a Moscow airport Saturday as part of attempts to stop it monitoring Sunday's vote for a new parliament, the group's lawyer said.

Golos leader Liliya Shibanova was held by customs officers at Sheremetyevo airport after returning from a trip abroad on the eve of the election, in which Vladimir Putin's United Russia is likely to have its huge parliamentary majority reduced.

The Western-funded group's lawyer, Ramid Akhmetgaliyev, told Reuters the customs officers copied contents of her laptop computer and Golos deputy head Grigory Melkonyants said her laptop had been confiscated.

Hours earlier, the United States had expressed concern about "what appears to be a pattern of harassment" of Golos, which has aired reports of alleged violations in Russian elections.

A Moscow court ruled late Friday that Golos had violated a ban on the publication of opinion poll results within five days of the election to the State Duma lower house.

During the campaign, Prime Minister Putin has accused foreign countries of meddling in the preparations for the election -- and for a March presidential election he is expected to win -- by funding organizations in Russia.

"The pressure on Golos and its leaders (is) an attempt to block their activities involving independent public monitoring of the election," Akhmetgaliyev said.

Akhmetgaliyev said customs authorities had no legal right to examine or copy the contents of Shibanova's computer and had violated her rights by preventing him seeing her during her detention.

"They told me that they had information that I was supposedly bringing some sort of dangerous software across the border," Shibanova told Ekho Moskvy radio.

Akhmetgaliyev also disputed the court decision, which came with a 30,000-rouble ($970) fine. He said Golos had published allegations of campaign violations, not opinion poll results.

U.S. President Barack Obama's administration expressed concern Friday about the court ruling.

"The Obama administration is concerned with today's decision by a Moscow court regarding ... Golos, as well as what appears to be a pattern of harassment directed against this organization," a White House spokesman said in a statement.

Before the court hearing, Moscow city prosecutors said they were investigating Golos over a complaint by lawmakers objecting to its foreign financing and urging it to stop vote monitoring.

Golos, a non-profit organization founded in 2000, has a hotline for electoral violation allegations and an interactive map showing reported violations.

It openly says its funding comes entirely from Europe and the United States and that this helps it remain objective.

PUTIN CRITICISES WESTERN MEDDLING

During his 2000-2008 presidency, Putin repeatedly accused the West of seeking to weaken Russia and of meddling in its affairs, including by funding non-governmental organizations meant to strengthen democracy.

Formally launching his bid to return to the Kremlin next year by accepting United Russia's nomination at a party congress last Sunday, Putin reiterated these accusations last month.

He said "representatives of some foreign countries are gathering those they are paying money to, so-called grant recipients, to instruct them and assign work in order to influence the election campaign themselves."

He said any such activity was a "wasted effort" because Russians would reject foreign-funded politicians, comparing them to Judas, the traitor of Jesus in the bible.

Critics in Russia and the West accuse Putin of curtailing democracy through a series of electoral reforms during his presidency, which coincided with an oil-fueled economic boom.

His announcement of plans to swap jobs with President Dmitry Medevedev upset some Russians who saw it as a back-room deal agreed with no regard for voters. Putin, 59, could be in power until 2024 if he wins the maximum two more terms as president.

United Russia, which has dominated the Duma since 2003, is expected to retain a clear majority in the chamber though the two-thirds that allow it to pass constitutional changes without opposition support may prove out of reach.

Many voters say they expect the party's result to be boosted by vote rigging and favorable coverage by traditional media. A liberal party led by former Prime Minister Mikhail Kasyanov and two allies is barred from even taking part.

The biggest gainers could be the Communist Party, which is likely to remain the second biggest force 20 years after the fall of the Soviet Union. Vladimir Zhirinovsky's nationalist LDPR also hopes to gain votes from United Russia.
