Courtroom battles are becoming an everyday inevitability across the mobile technology world, as that between Microsoft and Motorola Mobility rages on for another week. The latest development however in the alleged patent infringement case comes in the form of a judge?s recommendation that Microsoft?s Xbox 360 console be banned from sale in the US.
Motorola Mobility has continuously suggested that the Microsoft Xbox 360 steps of the toes of at least five patents, ranging from the console?s Wi-Fi connectivity to image decoding.
During April, it was decided by court judges that Microsoft has indeed infringed on at least four of the patents highlighted by Motorola, leading to concerns that a ban on US sales of the Xbox 360 may be ordered when the case comes to a conclusion.
However, courtroom reporters have now suggested that court judges have recommended that the Xbox 360 S console be removed from sale in the US sooner rather than later.
Microsoft is said to have countered the suggestion by stating that to do so would not be in the interests of the consumer, as the only two remaining options would be the Nintendo Wii and the Sony PlayStation.
This was then responded to by the judge who is reported to have reminded Microsoft that currently existing patents and intellectual property rights must be upheld and that economic and commercial impacts cannot be used as viable defense arguments. He also went on to suggest that there is little to no reason why Nintendo and Sony could not meet the needs of the market on their own.
A recommendation was made that a cease and desist order be passed which would ban the sale of Xbox 360 consoles in the US, while also demanding a bond payment from Microsoft equating to 7% of remaining console inventory.
